1. Quiénes somos

Aura DMC VOF es una sociedad general neerlandesa (Vennootschap onder Firma) formada por tres socios, inscrita en el Kamer van Koophandel con el número 42057938, con domicilio en Poortland 66, 1046 BD Amsterdam, Países Bajos. Operamos tours guiados a pie en Ámsterdam y tours guiados en automóvil y furgoneta (van) dentro de los Países Bajos, en inglés y español.

Somos responsables del tratamiento ("responsable del tratamiento" / verwerkingsverantwoordelijke) de los datos personales que recogemos a través de nuestro sitio web auratours.nl, de nuestras reservas directas, y de las reservas recibidas a través de plataformas asociadas.

2. Qué datos recogemos

Dependiendo de cómo interactúes con nosotros, podemos recoger:

a) Datos de reserva y contacto Nombre, apellidos, correo electrónico, número de teléfono, país de origen, número de participantes, idioma preferido, fecha y tipo de tour reservado, punto de encuentro, y cualquier requisito especial que nos comuniques (por ejemplo, movilidad reducida o alergias relevantes para el tour).

b) Datos de pago Cuando reservas y pagas directamente en nuestro sitio, los datos de tu tarjeta o método de pago son procesados directamente por nuestro proveedor de pagos (Mollie B.V.); nosotros no almacenamos los datos completos de tu tarjeta. Conservamos únicamente el registro de la transacción (monto, fecha, estado del pago) necesario para nuestra contabilidad.

c) Datos técnicos y de navegación Datos agregados de visitas a través de GoatCounter (sin identificación individual). Actualmente no usamos Google Analytics ni herramientas similares; si lo incorporamos en el futuro, actualizaremos esta política y solicitaríamos tu consentimiento antes de activarlo (ver nuestra Política de Cookies para más detalle).

d) Datos recibidos a través de plataformas asociadas Cuando reservas a través de Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk u otras plataformas asociadas, dichas plataformas nos transmiten los datos necesarios para gestionar tu reserva (nombre, contacto, detalles de la reserva). El tratamiento inicial de tus datos en esas plataformas se rige por sus propias políticas de privacidad, independientes de la nuestra.

e) Comunicaciones Si nos escribes por correo electrónico o completas un formulario de contacto, conservamos esa comunicación y los datos que nos facilites en ella para poder responderte.

No usamos tus datos para decisiones automatizadas ni perfiles con efectos jurídicos sobre ti.

4. Con quién compartimos tus datos

No vendemos tus datos personales a terceros. Los compartimos únicamente cuando es necesario para prestarte el servicio o cumplir con la ley, con:

Nuestro proveedor de pagos (Mollie B.V.), para procesar transacciones.
Nuestras plataformas de reserva asociadas (Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk), en la medida necesaria para confirmar y gestionar reservas realizadas a través de ellas.
Nuestros guías ZZP (autónomos) que puedan operar un tour en nuestro nombre, exclusivamente los datos operativos necesarios (nombre, número de participantes, punto de encuentro, idioma) — nunca datos de pago.
Nuestro proveedor de alojamiento web (Netlify, Inc.), que aloja y sirve nuestro sitio auratours.nl, y que como parte del funcionamiento normal del hosting registra datos técnicos de acceso (dirección IP, fecha y hora de la solicitud).
Otros proveedores tecnológicos que nos ayudan a operar el sitio web y nuestra herramienta de analítica (GoatCounter).
Nuestro proveedor de correo electrónico (Google Workspace), a través del cual gestionamos la correspondencia enviada a info@auratours.nl.
Autoridades públicas, cuando estemos legalmente obligados a ello (por ejemplo, requerimientos fiscales o de seguridad pública).

Transferencias internacionales

Si en el futuro activamos Google Analytics u otra herramienta similar y aceptas sus cookies analíticas, esos datos podrían transferirse a servidores de Google LLC en Estados Unidos. Nuestro proveedor de alojamiento web, Netlify, Inc., tiene su sede en Estados Unidos y opera una red de distribución de contenido (CDN) global; el tratamiento de los datos técnicos de acceso a nuestro sitio puede por tanto implicar una transferencia internacional. Ambas transferencias se realizan bajo las Cláusulas Contractuales Tipo de la Comisión Europea, como mecanismo válido de transferencia internacional conforme al RGPD. El resto de nuestros proveedores (GoatCounter, Mollie) alojan los datos dentro de la Unión Europea.

5. Cuánto tiempo conservamos tus datos

Datos de reserva y facturación: durante el tiempo exigido por la legislación fiscal neerlandesa (en general, 7 años).
Comunicaciones por correo electrónico: hasta 2 años después del último contacto, salvo que exista una relación comercial activa.
Datos de suscripción a newsletter: hasta que retires tu consentimiento.
Datos analíticos agregados: sin límite, por no ser identificables individualmente (GoatCounter). Si en el futuro activamos Google Analytics, sus datos se conservarían según la configuración de retención de GA4 (máximo 14 meses para datos a nivel de evento).

6. Tus derechos

Conforme al Reglamento General de Protección de Datos (RGPD) y la ley neerlandesa de ejecución (AVG/UAVG), tienes derecho a:

Acceder a los datos personales que tenemos sobre ti.
Rectificar datos inexactos o incompletos.
Suprimir tus datos, cuando ya no sean necesarios o retires tu consentimiento.
Limitar el tratamiento en determinadas circunstancias.
Oponerte al tratamiento basado en interés legítimo o con fines de marketing directo.
Portabilidad: recibir tus datos en un formato estructurado y de uso común.
Retirar tu consentimiento en cualquier momento, sin que ello afecte la licitud del tratamiento previo.

Para ejercer cualquiera de estos derechos, escríbenos a info@auratours.nl. Responderemos en un plazo máximo de un mes.

Si consideras que no hemos gestionado correctamente tus datos, tienes derecho a presentar una reclamación ante la Autoriteit Persoonsgegevens (Autoridad neerlandesa de Protección de Datos), a través de autoriteitpersoonsgegevens.nl.

7. Seguridad de tus datos

Aplicamos medidas técnicas y organizativas razonables para proteger tus datos personales contra acceso no autorizado, pérdida o alteración, incluyendo el uso de conexiones cifradas (SSL/TLS) en nuestro sitio web y en el procesamiento de pagos a través de Mollie. Ningún sistema es 100% infalible, pero trabajamos activamente para minimizar los riesgos.

8. Menores de edad

Nuestros tours pueden incluir a menores de edad acompañados de un adulto responsable de la reserva. No recogemos deliberadamente datos personales de menores sin la intervención de un adulto responsable de la reserva.

9. Cambios a esta política

Podemos actualizar esta política de privacidad para reflejar cambios en nuestros servicios, proveedores o en la legislación aplicable. La fecha de "última actualización" al inicio de este documento indica la versión vigente. Te recomendamos revisarla periódicamente.

1. Who we are

Aura DMC VOF is a Dutch general partnership (Vennootschap onder Firma) formed by three partners, registered with the Kamer van Koophandel under number 42057938, with its registered address at Poortland 66, 1046 BD Amsterdam, The Netherlands. We operate guided walking tours in Amsterdam and guided tours by car and van (minivan) within the Netherlands, in English and Spanish.

We are the controller ("data controller" / verwerkingsverantwoordelijke) of the personal data we collect through our website auratours.nl, through direct bookings, and through bookings received via partner platforms.

2. What data we collect

Depending on how you interact with us, we may collect:

a) Booking and contact details Name, surname, email address, phone number, country of origin, number of participants, preferred language, date and type of tour booked, meeting point, and any special requirements you communicate to us (for example, reduced mobility or allergies relevant to the tour).

b) Payment data When you book and pay directly on our site, your card or payment method details are processed directly by our payment provider (Mollie B.V.); we do not store your full card details. We only keep the transaction record (amount, date, payment status) necessary for our accounting.

c) Technical and browsing data Aggregated visit data through GoatCounter (without individual identification). We do not currently use Google Analytics or similar tools; if we introduce one in the future, we will update this policy and request your consent before activating it (see our Cookie Policy for more detail).

d) Data received through partner platforms When you book through Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk or other partner platforms, those platforms send us the data necessary to manage your booking (name, contact details, booking details). The initial processing of your data on those platforms is governed by their own privacy policies, independent of ours.

e) Communications If you write to us by email or complete a contact form, we keep that communication and the data you provide in it in order to respond to you.

We do not use your data for automated decisions or profiling with legal effects on you.

4. Who we share your data with

We do not sell your personal data to third parties. We share it only when necessary to provide the service or comply with the law, with:

Our payment provider (Mollie B.V.), to process transactions.
Our partner booking platforms (Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk), to the extent necessary to confirm and manage bookings made through them.
Our self-employed guides (ZZP) who may operate a tour on our behalf, exclusively the operational data necessary (name, number of participants, meeting point, language) — never payment data.
Our web hosting provider (Netlify, Inc.), which hosts and serves our website auratours.nl, and which, as part of normal hosting operation, records technical access data (IP address, date and time of the request).
Other technology providers that help us operate the website and our analytics tool (GoatCounter).
Our email provider (Google Workspace), through which we manage correspondence sent to info@auratours.nl.
Public authorities, when we are legally required to do so (for example, tax or public security requirements).

International transfers

If we activate Google Analytics or a similar tool in the future and you accept its analytics cookies, that data could be transferred to Google LLC servers in the United States. Our web hosting provider, Netlify, Inc., is headquartered in the United States and operates a global content distribution network (CDN); processing of the technical access data for our site may therefore involve an international transfer. Both transfers take place under the European Commission's Standard Contractual Clauses, as a valid international transfer mechanism under the GDPR. Our other providers (GoatCounter, Mollie) host data within the European Union.

5. How long we keep your data

Booking and billing data: for the period required by Dutch tax law (generally, 7 years).
Email communications: up to 2 years after the last contact, unless there is an active business relationship.
Newsletter subscription data: until you withdraw your consent.
Aggregated analytics data: without time limit, as it is not individually identifiable (GoatCounter). If we activate Google Analytics in the future, its data would be retained according to GA4's retention settings (maximum 14 months for event-level data).

6. Your rights

Under the General Data Protection Regulation (GDPR) and the Dutch implementing law (AVG/UAVG), you have the right to:

Access the personal data we hold about you.
Rectify inaccurate or incomplete data.
Erase your data, when it is no longer necessary or you withdraw your consent.
Restrict processing in certain circumstances.
Object to processing based on legitimate interest or for direct marketing purposes.
Portability: receive your data in a structured, commonly used format.
Withdraw your consent at any time, without affecting the lawfulness of prior processing.

To exercise any of these rights, write to us at info@auratours.nl. We will respond within a maximum of one month.

If you believe we have not properly handled your data, you have the right to lodge a complaint with the Autoriteit Persoonsgegevens (Dutch Data Protection Authority), at autoriteitpersoonsgegevens.nl.

7. Security of your data

We apply reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, or alteration, including the use of encrypted connections (SSL/TLS) on our website and in payment processing through Mollie. No system is 100% foolproof, but we work actively to minimize risks.

8. Minors

Our tours may include minors accompanied by a responsible adult. We do not knowingly collect personal data from minors without the involvement of an adult responsible for the booking.

9. Changes to this policy

We may update this privacy policy to reflect changes in our services, providers, or applicable legislation. The "last updated" date at the top of this document indicates the current version. We recommend reviewing it periodically.

1. Wie wij zijn

Aura DMC VOF is een Nederlandse vennootschap onder firma (VOF), gevormd door drie vennoten, ingeschreven bij de Kamer van Koophandel onder nummer 42057938, met als statutair adres Poortland 66, 1046 BD Amsterdam, Nederland. Wij organiseren begeleide wandeltochten in Amsterdam en begeleide tochten per auto en busje (van) binnen Nederland, in het Engels en Spaans.

Wij zijn de verwerkingsverantwoordelijke voor de persoonsgegevens die wij verzamelen via onze website auratours.nl, via directe boekingen, en via boekingen ontvangen via partnerplatforms.

2. Welke gegevens wij verzamelen

Afhankelijk van hoe u met ons omgaat, kunnen wij het volgende verzamelen:

a) Boekings- en contactgegevens Naam, achternaam, e-mailadres, telefoonnummer, land van herkomst, aantal deelnemers, voorkeurstaal, datum en type geboekte tour, ontmoetingspunt, en eventuele bijzondere vereisten die u aan ons doorgeeft (bijvoorbeeld verminderde mobiliteit of allergieën die relevant zijn voor de tour).

b) Betalingsgegevens Wanneer u rechtstreeks op onze website boekt en betaalt, worden de gegevens van uw kaart of betaalmethode rechtstreeks verwerkt door onze betalingsprovider (Mollie B.V.); wij slaan uw volledige kaartgegevens niet op. Wij bewaren alleen de transactiegegevens (bedrag, datum, betalingsstatus) die nodig zijn voor onze boekhouding.

c) Technische en navigatiegegevens Geaggregeerde bezoekgegevens via GoatCounter (zonder individuele identificatie). Wij gebruiken momenteel geen Google Analytics of vergelijkbare tools; als wij dit in de toekomst invoeren, werken wij dit beleid bij en vragen wij uw toestemming voordat wij het activeren (zie ons Cookiebeleid voor meer details).

d) Gegevens ontvangen via partnerplatforms Wanneer u boekt via Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk of andere partnerplatforms, sturen die platforms ons de gegevens die nodig zijn om uw boeking te beheren (naam, contactgegevens, boekingsgegevens). De initiële verwerking van uw gegevens op die platforms valt onder hun eigen privacybeleid, onafhankelijk van het onze.

e) Communicatie Als u ons een e-mail stuurt of een contactformulier invult, bewaren wij die communicatie en de gegevens die u daarin verstrekt om u te kunnen antwoorden.

Wij gebruiken uw gegevens niet voor geautomatiseerde besluitvorming of profilering met juridische gevolgen voor u.

4. Met wie wij uw gegevens delen

Wij verkopen uw persoonsgegevens niet aan derden. Wij delen ze alleen wanneer dit noodzakelijk is om de dienst te leveren of om aan de wet te voldoen, met:

Onze betalingsprovider (Mollie B.V.), om transacties te verwerken.
Onze partner-boekingsplatforms (Hotelbeds, Civitatis, GetYourGuide, Viator, I Need Tours, GuruWalk), voor zover noodzakelijk om via hen gemaakte boekingen te bevestigen en te beheren.
Onze zelfstandige gidsen (ZZP) die namens ons een tour kunnen uitvoeren, uitsluitend de operationele gegevens die noodzakelijk zijn (naam, aantal deelnemers, ontmoetingspunt, taal) — nooit betalingsgegevens.
Onze webhostingprovider (Netlify, Inc.), die onze website auratours.nl host en levert, en die als onderdeel van de normale hostingwerking technische toegangsgegevens registreert (IP-adres, datum en tijd van het verzoek).
Andere technologieleveranciers die ons helpen bij het beheren van de website en onze analysetool (GoatCounter).
Onze e-mailprovider (Google Workspace), waarmee wij correspondentie naar info@auratours.nl beheren.
Overheidsinstanties, wanneer wij daartoe wettelijk verplicht zijn (bijvoorbeeld fiscale of openbare veiligheidsvereisten).

Internationale doorgiften

Als wij in de toekomst Google Analytics of een vergelijkbare tool activeren en u de analytische cookies accepteert, kunnen die gegevens worden doorgegeven aan servers van Google LLC in de Verenigde Staten. Onze webhostingprovider, Netlify, Inc., heeft zijn hoofdkantoor in de Verenigde Staten en exploiteert een wereldwijd content distributienetwerk (CDN); de verwerking van de technische toegangsgegevens van onze website kan daarom een internationale doorgifte inhouden. Beide doorgiften vinden plaats op basis van de Standaardcontractbepalingen van de Europese Commissie, als geldig mechanisme voor internationale gegevensoverdracht onder de AVG. Onze overige leveranciers (GoatCounter, Mollie) bewaren gegevens binnen de Europese Unie.

5. Hoe lang wij uw gegevens bewaren

Boekings- en factuurgegevens: gedurende de periode vereist door de Nederlandse belastingwetgeving (in het algemeen 7 jaar).
E-mailcommunicatie: tot 2 jaar na het laatste contact, tenzij er een actieve zakelijke relatie bestaat.
Nieuwsbriefgegevens: totdat u uw toestemming intrekt.
Geaggregeerde analysegegevens: zonder tijdslimiet, aangezien deze niet individueel identificeerbaar zijn (GoatCounter). Als wij Google Analytics in de toekomst activeren, worden die gegevens bewaard volgens de bewaarinstellingen van GA4 (maximaal 14 maanden voor gegevens op gebeurtenisniveau).

6. Uw rechten

Op grond van de Algemene Verordening Gegevensbescherming (AVG/GDPR) en de Nederlandse uitvoeringswet (UAVG) heeft u het recht om:

Toegang te krijgen tot de persoonsgegevens die wij over u hebben.
Onjuiste of onvolledige gegevens te corrigeren.
Uw gegevens te laten wissen, wanneer deze niet langer noodzakelijk zijn of u uw toestemming intrekt.
De verwerking te beperken in bepaalde omstandigheden.
Bezwaar te maken tegen verwerking op basis van gerechtvaardigd belang of voor direct marketingdoeleinden.
Dataportabiliteit: uw gegevens te ontvangen in een gestructureerd, gangbaar formaat.
Uw toestemming op elk moment in te trekken, zonder dat dit de rechtmatigheid van de eerdere verwerking aantast.

Om een van deze rechten uit te oefenen, kunt u ons schrijven op info@auratours.nl. Wij reageren binnen maximaal één maand.

Als u van mening bent dat wij uw gegevens niet correct hebben verwerkt, heeft u het recht om een klacht in te dienen bij de Autoriteit Persoonsgegevens, via autoriteitpersoonsgegevens.nl.

7. Beveiliging van uw gegevens

Wij passen redelijke technische en organisatorische maatregelen toe om uw persoonsgegevens te beschermen tegen ongeautoriseerde toegang, verlies of wijziging, waaronder het gebruik van versleutelde verbindingen (SSL/TLS) op onze website en bij betalingsverwerking via Mollie. Geen enkel systeem is 100% waterdicht, maar wij werken actief aan het minimaliseren van risico's.

8. Minderjarigen

Onze tours kunnen minderjarigen omvatten die worden begeleid door een verantwoordelijke volwassene. Wij verzamelen niet bewust persoonsgegevens van minderjarigen zonder tussenkomst van een voor de boeking verantwoordelijke volwassene.

9. Wijzigingen in dit beleid

Wij kunnen dit privacybeleid bijwerken om wijzigingen in onze diensten, leveranciers of toepasselijke wetgeving weer te geven. De datum "laatst bijgewerkt" bovenaan dit document geeft de huidige versie weer. Wij raden u aan dit beleid regelmatig te raadplegen.
